1. General

The TU Wien website contains photographs at https://www.tuwien.at/en/services/media/photo-download, opens an external URL in a new window and on sub-pages, to which TU Wien exclusively holds the rights (of use). The photographs published on the TU Wien website are protected under copyright law. Please note that the image descriptions were up to date at the time when the photograph was taken.

By downloading the photographs, users accept these terms of use.

2. Granting of rights

For the photographs to which TU Wien holds the rights (of use), TU Wien grants permission which is

  1. non-transferable
  2. non-exclusive
  3. valid until revoked and territorially limited,

to use the photographs free of charge with indication of the respective copyright (see point 3) for

  1. journalistic or
  2. non-commercial purposes

in connection with reporting on TU Wien in print and/or online media.

The following are NOT permitted for users:

  1. Use of the photographs for commercial purposes such as advertising.
  2. Use downloaded photographs in a misleading manner or in a way that is likely to harm TU Wien; in particular, use these photographs to disseminate information or content that is detrimental to TU Wien.
  3. Use photographs made available on the website 
    1. for prohibited acts of any kind
    2. in a morally objectionable manner or
    3. for party-political or religious purposes.
  4. Impair or affect the personal rights of the persons depicted negatively.
  5. Any dissemination and publication for payment.

3. Copyright

In case of publication, users are always obliged to indicate the photo credit or copyright, especially in printed works, but also in social media posts, as follows: “© TU Wien” or “© Photographer’s Name”.

4. No editing

Any form of editing, redesign or manipulation of the photographs that goes beyond minor colour corrections, cropping and resizing is prohibited and only permitted with the prior written consent of TU Wien/Service Unit of PR and Marketing.

5. Violation

Permission to use the work, once granted, shall expire if the user violates the conditions of use set forth herein.

In this case, the downloaded photographs must be removed from all of the user’s data storage devices immediately. Archiving is not permitted.

After unauthorised use of a photograph, no new permission will be granted to use that photograph.

Users shall indemnify TU Wien and hold it harmless in the event of claims by third parties where users cause or bring about the unauthorised use of photographs. TU Wien reserves the right to claim further damages.

6. Warranty, liability

TU Wien accepts no liability for the actual and legal usability of the photographs; in particular, it is not responsible for their optical quality and authenticity.

The liability of TU Wien is limited to intentional acts or gross negligence. Any further liability is excluded. TU Wien is not liable for damages suffered by users due to expiry of permission to use the work.

7. Applicable law, jurisdiction

These conditions of use shall be governed by Austrian law, to the exclusion of the conflict-of-law rules of Austrian international private law and the United Nations Convention on Contracts for the International Sale of Goods. The competent court of Inner City (Innere Stadt) Vienna, Austria, is the place of jurisdiction for all disputes arising from these conditions of use.

If individual provisions of these conditions of use are or become invalid or unenforceable, this shall not affect the validity of the other provisions. Invalid or unenforceable provisions shall, by mutual agreement, be replaced by a valid or enforceable provision that comes as close as possible to the invalid or unenforceable provision in terms of its economic outcome.
