Areas of Responsibility

The tasks of the independent arbitration committee pursuant to Section 43 (1) of the University Act 2002 include:

  • Mediation in disputes between members of the university
Any member of the university (staff or students) may directly contact the Arbitration Committee for mediation in a matter relating to their work at the university that is in dispute between them and another member of the university or a university body.
The Arbitration Committee can only act as a mediator and propose solutions, but it does not represent the university member requesting mediation and may not take the decision in the disputed matter itself.
  • Decision on complaints lodged by the Working Group on Equal Treatment regarding discrimination on the basis of gender or ethnic origin, religion or belief, age or sexual orientation by a decision of a university body
  • Decision on complaints regarding a violation of the requirement to promote women or a violation of provisions of the university's plan for the promotion of women or equality
  • Decision on objections to the incorrect composition of a collegial body
  • Decision on objections to the inadequacy of the election proposal

Objections regarding the incorrect composition of the collegial body and objections regarding the inadequacy of the election proposal shall be raised by the Working Group on Equal Treatment Issues if the proportion of women of at least 50% is not sufficiently maintained. This applies to the appointment of members of the Senate, the University Council, or any other collegial body, in particular the commissions to be appointed by the Senate, as well as all nominations for the Senate election.

Matters subject to legal appeal (e.g., proceedings in study matters, habilitation and service law proceedings) and performance assessments (e.g., assessments of examinations and academic work) are excluded from review by the Arbitration Committee.

The Arbitration Committee consists of six members and six substitute members who are not bound by any instructions or orders in the performance of their duties. One male and one female member and one male and one female substitute member are to be nominated by the Senate, the University Council, and the Working Group on Equal Treatment Issues for a term of two years.
